Terms of Service

These Terms of Service (“Terms”) are between you (“Customer”) and Drift Wraps (“Company”), and apply to services (“Services”) provided by Company to Customer.  These Terms may be modified by Company in its sole discretion from time to time, provided that the Terms in effect at the time Company agrees in writing to provide Services to Customer will apply to such Services.  It is Customer’s responsibility to visit the latest Terms at www.driftwrapsautostyling.com/terms before requesting and receiving Services.

 

Payment; Deposit; Disputes.  Full payment in cash or other immediately available funds is required before release of your vehicle or products (“Pickup”).  Company may accept payment by check but reserves the right to require, in its sole discretion, payment by cash or other immediately available funds.  If Company accepts payment by check, Company will charge a fee of $50 for each returned check.A non-refundable deposit of 50% of the invoiced cost of the Services (plus the cost of Materials, as discussed below) is payable in advance, provided, however that Company may require a greater deposit amount for certain Services, in which case such deposit amount will be set forth on the corresponding order form.  Customers are liable for collection fees, attorney fees, and court costs for unpaid balances, as well as interest at the greater of 18% per annum interest and the maximum interest permitted by applicable law.  You agree to inspect the vehicle upon receipt and raise any concerns prior to removing your vehicle from Company’s premises, otherwise the job will be deemed accepted.  Any invoice disputes must be communicated in writing to Company within ten days of invoice date.  Otherwise, invoice will be deemed accepted.  In the event of any dispute (“Dispute”) relating to or arising from these Terms or the Services, the parties will, before initiating any legal action or arbitration, meet and confer within 30 days after notice by the aggrieved party to negotiate a resolution of such dispute.  Within 20 days after such negotiations fail, if applicable, the aggrieved Party will, before initiating any legal action or arbitration, request that the Judicial Arbitration and Mediation Service (“JAMS”) choose a neutral mediator to conduct an in-person mediation at a neutral location within 30 days of contact with JAMS, the fee for which will be jointly shared.  If a Dispute remains unresolved after the process set forth above, it will be submitted to an arbitrator (“Arbitrator”) for arbitration (“Binding Arbitration”), and the Parties will be bound by the Arbitrator’s decision.  Each Party is responsible for its own costs of Binding Arbitration, including without limitation its own attorney’s fees), other than the Arbitrator fees and expenses and host location fees and expenses, which the Parties will share equally.

 

Materials; Changes; Additional Fees.  The cost of any materials for Services (“Materials”) are required to be paid in advance before Services will begin.  The material that is ordered is non-refundable and there is a 30% restocking fee on top of the already purchased cost if you do not proceed forward with the corresponding Services.  Any requested modifications to the type or scope of Services must be accepted by Company in writing.  You have 24 hours to cancel and change the installation appointment date.  If you miss your install appointment date there will be an additional $40 charge.  There will not be any price change once the date has been finalized and deposit is made.  Vinyl Materials are non-returnable and non-refundable once the material is installed per the customer’s personal request.  Company is not the manufacture of Materials and any warranties are the responsibility of the corresponding manufacturer.  It is Customer’s responsibility to obtain any warranty information from such manufacture before requesting Services.  Vehicles left beyond the date that Company notifies Customer that the vehicle is ready to be picked up will be charged $35.00 per day, per space occupied, until the vehicle or vehicles have been picked up and paid for.  Please note that an additional $50 fee applies if Customer and Company agree on a time and date of pickup and Customer fails to do so.

 

DISCLAIMER OF WARRANTIES.  TO THE EXTENT PERMITTED BY APPLICALBE LAW, COMPANY PROVIDES THE SERVICES AND MATERIALS ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR THE USE BY THE CUSTOMER WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.  NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT, COMPANY DOES NOT REPRESENT OR WARRANT THAT THE SERVICES OR MATERIALS PROVIDED WILL MEET THE CUSTOMER’S REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE OR WORK WITH ANY OTHER PAINT, FINISH, VEHICLE, APPLICATIONS, SYSTEMS OR SERVICES, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS OR BE ERROR-FREE, OR THAT ANY ERRORS OR DEFECTS CAN BE CORRECTED.  FURTHER, COMPANY MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION PROVIDED BY COMPANY, AND NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM COMPANY, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.  CUSTOMER ACKNOWLEDGES AND AGREES THAT ANY USE OF THE SERVICES AND MATERIALS IS AT CUSTOMER’S SOLE RISK. THIS DISCLAIMER CONSTITUTES AN ESSENTIAL PART OF THIS AGREEMENT.

 

Vehicle Preparation.  For all Services, Customer must wash Customer’s vehicle using ONLY water and soap before dropping the vehicle off with Company (“Dropoff”).  Although Company will prepare and clean the vehicle prior to providing Services, wax and other chemicals can prevent vinyl from properly adhering to the vehicle.  DO NOT WAX THE VEHICLE OR USE A CLAY BAR PRIOR TO DROPOFF.  An additional charge of $20 will apply if Company, in its reasonable discretion, has to wash the vehicle.  Customer agrees to remove vehicle emblems, badges, mirrors, existing vinyl and door handles (“Accessories”) from the vehicle prior to Dropoff.  There will be an extra charge of $80.00 per hour if Company must (in its discretion) remove Accessors from the vehicle.  Company is not liable for any damage that may result to Customer’s vehicle for removal of Accessories.

 

Installation.  Vinyl material is a pliable plastic material that we make every effort to make it look as seamless as possible.  However, curves, bumps, rivets, moldings and deep-channeled curves may appear that the vinyl may not conform to.  In some cases, relief cuts need to be made or patches need to be installed to cover certain areas.  Stretching will result in some shrinkage as it attempts to return to its original form/dimensions.  As it shrinks, some minor lifting may occur and will be addressed by Company (if necessary, in Company’s reasonable discretion), provided that Customer notifies Company of such issue within 90 days after Pickup.

 

Custom Artwork.  If artwork was provided by the customer, Company is not responsible for any errors or quality of images or artwork. Once artwork is approved by customer any changes done before and after production will have an extra cost depending on the size of the reprint and time of design making the changes.

 

Custom Artwork.  Customer is responsible for providing accurate custom artwork (e.g., company logos, designs) in a high-resolution format and complete and accurate text (“Design”).  All Design Services include three hours of design and up to two mockups, $85 per additional hour thereafter.  Graphics are available for purchase.  Design changes and corrections are charged at a rate of $85.00 an hour.  Mock-up template approved is rendition is an artistic representation of what your graphics will look like. Company reserves the right to slightly modify certain measurements and/or areas to accommodate production and installation. As this color rendition is generated by computer, the colors may vary slightly from actual decal material. Reprints will result in an extra charge. Final color may print slightly different than the computer screen proof and print proof. Sample Template is only a mock-up, because Templates may sometimes be smaller or larger than actual vehicle and our wrapper will place the printed wrap slightly different than the template to fit your vehicle due to vehicles curvature and size. When Color Matching, there is no warranty we can print the exact color and customer is responsible for asking Company to Print Color Samples on vinyl material before production to ensure they are getting the color they want printed. Reprints and multiple prints may also be slightly different shade from last print due to humidity & temperature, there are no refunds, reprints or redo's, this is out of our control. Once artwork is approved, there is absolutely no changes to artwork because it's already in production. If there are any changes after or during production customer will have to pay extra for corrections and new prints. 

 

Removal of Personal Items.  Please remove all personal items before delivering your vehicle.  We are not responsible for such items.
